What is Blood Alcohol Level?

Texas DWI laws define an over limit blood alcohol concentration as:

Blood Test - 0.08 grams of alcohol per 100 milliliters of blood
Urine Test - 0.08 grams of alcohol per 67 milliliters of urine.
Breath Test - 0.08 of grams of alcohol per 210 liters of breath.

Depending on your body weight, even a few drinks can put you over the legal BAC limit in the State of Texas.  Be sure to ALWAYS have a designated driver if you choose to drink and party.

Should I refuse a breath test?


Yes, you have the right to refuse the breath test. Breath test devices (breathalyzers) can make mistakes as do the officers or staff members who operate those devices. If the device is broken or not working properly, it may read your breath alcohol concentrations at or above the legal limit of 0.08 in error. This could lead to the use of such faulty evidence in an attempt to convict you of DWI.

Will a dwi remain on my record?


A DWI charge will remain on your record for life even if it is dismissed, unless you qualify and file for expunction or non-disclosure.  Many people mistakenly believe that previous charges or offenses automatically come of their record after a certain time frame.  Unfortunately, even a dismissed misdemeanor DWI charge can remain on your for a minimum of 2 years after the date of dismissal before it is eligible for an expunction.  If you are charged with DWI in the State of Texas, Barringer Law Office can help you get your DWI dismissed.

How do i get my license back?

You have 15 days from the date that you receive written notice that your driver’s license will be suspended to request an Administrative License Revocation hearing.  This hearing is separate from the criminal proceedings.  You map apply for an occupational license which will would allow you to drive your vehicle at certain hours of the day.  In most instances you may be required to install a Breath Alcohol Ignition system.
